The Canadian privacy position, as it actually stands
Canada still runs on PIPEDA, drafted in 2000, and has no federal AI statute. Bill C-27 — which would have replaced PIPEDA with the Consumer Privacy Protection Act and introduced the Artificial Intelligence and Data Act — died when Parliament was prorogued in January 2025. A third attempt, Bill C-36, the Protecting Privacy and Consumer Data Act, was tabled in June 2026 and is expected to reach second reading in the fall.
The practical consequence for Canadian businesses is that the meaningful compliance baseline is not federal at all. Quebec Law 25 is materially stricter than PIPEDA and applies to any organization handling the personal information of Quebec residents, regardless of where that organization sits. Ontario health data falls under PHIPA; Alberta and British Columbia run their own PIPAs. We build to the strictest applicable standard rather than the federal floor, which also means less rework when C-36 lands.

Canadian businesses investing in qualifying AI development work may be eligible for SR&ED tax credits; we can supply the technical documentation your accountant needs, though we are not tax advisors.

Does PIPEDA prevent us from using AI agents?
No. PIPEDA governs how you collect, use and disclose personal information, not whether software makes the decision. The obligations that matter in practice are consent, purpose limitation, accuracy, safeguards and being able to explain a decision that affects someone. Those are design requirements, and we build to them.
What happens to our deployment if Bill C-36 passes?
C-36 borrows heavily from the same concepts as the earlier CPPA drafts, and Quebec Law 25 already anticipates much of it. Because we build to the strictest applicable provincial standard rather than the federal floor, deployments should need adjustment rather than redesign.
